Event Experience Terms and Conditions

These Terms and Conditions govern the agreement between you (the “Participant”) and Xplor Miles Sports Event Marketing LLC, a company incorporated in the United Arab Emirates, operating under the brand name Explor42 (the “Company”), in relation to the sports event tour package or experience (the “Tour”).

By booking and making payment for the Tour, you confirm that you have read, understood, and accepted these Terms and Conditions, together with the Company’s general Terms and Conditions available at www.explor42.com/templates/terms-and-conditions.

1. Services Provided

The Tour includes only the services expressly listed on the relevant event page, experience brochure, and booking confirmation. These may include race entry or an event ticket, accommodation, transfers, visa assistance, logistics, and on-ground support.

A confirmed race entry or event ticket is included only where Explor42 is authorized to provide it and it is expressly included in the booked package. Accommodation-only experiences do not include race entry.

Certain events and experiences are self-supported, while selected experiences include on-ground support, coordination, and hospitality provided by Explor42. Please refer to the relevant event page on the website or the experience brochure for the level of support and detailed inclusions.

Services are subject to supplier availability and third-party confirmation.

2. Booking and Payment

2.1 Booking Confirmation and Payment Schedule

All bookings must be made through authorized Explor42 channels. A booking is confirmed only after receipt of the required deposit or full payment.

The balance payment must be received no later than 90 days before the Tour start date. Bookings made within 120 days of the Tour start date require full payment at the time of booking.

All prices are quoted per person, unless otherwise stated. Failure to meet payment deadlines may result in cancellation of the booking and applicable cancellation charges.

2.2 Pricing Currency

All experiences are priced and invoiced in AED (UAE dirhams). Participants may pay in AED or pay the INR equivalent from an Indian bank account through a secure payment link.

For INR payments, the payment link shows the AED price, exact INR equivalent, and payment-gateway charge before payment.

2.3 Payments in AED

AED bank transfer: No additional payment-gateway charge applies. Bank details are provided on the invoice.
AED card or online payment: A 3.2% payment-gateway charge applies.

Any bank charges are borne by the Participant.

2.4 Payments in INR

Payments are accepted through UPI, net banking, or debit or credit card.
A 3.2% payment-gateway charge applies to every INR payment method.
The INR amount is calculated at the mid-market exchange rate on the day the payment link is created and remains fixed until the link expires.
The payer’s PAN is required for payments under the Liberalised Remittance Scheme (LRS).

A quote and its payment link remain valid for five days. After expiry, the exchange rate is refreshed for a new quote and payment link.

2.5 Pricing and Taxes

Prices may change before booking confirmation. Applicable taxes are included unless stated otherwise. Any subsequent increase in statutory taxes or supplier tariffs will be charged to the Participant.

3. Cancellation Refund and Transfer Policy

3.1 Cancellation by the Participant

All cancellation requests must be submitted in writing to hello@explor42.com. Cancellation charges are determined by the date the Company receives the written request and calculated in AED.

90 days or more before departure: Loss of deposit.
60 to 89 days before departure: 50% of the total Tour cost.
30 to 59 days before departure: 75% of the total Tour cost.
Fewer than 30 days before departure: 100% of the total Tour cost.

3.2 Non-Refundable Items

Marathon bib and event registration fees are strictly non-refundable and non-transferable.

Other non-refundable or non-recoverable costs, including visa fees, insurance premiums, accommodation, flights, and third-party services, will be communicated at booking. Refund eligibility for these services remains subject to the relevant supplier’s policies.

Any applicable refund will reflect the cancellation charges and non-refundable components of the confirmed booking.

3.3 Refunds for Payments in AED

Refund amounts are calculated in AED under the applicable cancellation policy and returned in AED through the original payment method.

The 3.2% payment-gateway charge is non-refundable. AED bank transfers carry no payment-gateway charge.

3.4 Refunds for Payments in INR

Refund amounts are calculated in AED under the applicable cancellation policy and returned in INR to the original account, UPI, or card.

The INR refund is calculated using the same exchange rate applied to the original payment, rather than the exchange rate on the refund date. Subsequent exchange-rate movements do not affect the refund.

The 3.2% payment-gateway charge is non-refundable.

3.5 Refund Confirmation and Processing

Refund processing time depends on the bank and payment method. Once a refund is determined, the Company will confirm the refund amount, currency, and reference in writing.

3.6 Transfers

Marathon bibs and event registrations are non-transferable. Transfers of other package components may be permitted up to 30 days before the event, subject to supplier approval and applicable charges.

4. Assumption of Risk and Indemnification

4.1 Health Fitness and Medical Responsibility

The Participant acknowledges that endurance sports events are physically demanding and involve inherent risks.

You confirm that you are medically fit to participate and accept responsibility for your health, fitness, and medical condition. You are strongly advised to consult a qualified medical professional before participation.

By booking the Tour, you voluntarily assume the inherent risks associated with participation, including injury, illness, accidents, weather conditions, traffic, course conditions, and interactions with other participants.

4.2 Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Explor42, Xplor Miles Sports Event Marketing LLC, its directors, employees, agents, partners, and suppliers against claims, liabilities, losses, damages, costs, and reasonable legal expenses arising from your participation, conduct, or breach of these Terms and Conditions.

5. Visa Passport and Travel Documents

The Participant is responsible for obtaining and carrying all required travel documents, including a valid passport, visas, permits, and mandatory health or vaccination certificates.

Visa assistance, where included, does not guarantee approval. The Company is not responsible for visa rejection, processing delays, denial of entry, deportation, or failure to obtain the required documentation.

Visa refusal or denial of entry does not create an automatic entitlement to a refund. Any cancellation and refund will be assessed under Section 3, including applicable cancellation charges and non-refundable costs.

6. Event Cancellation Alteration and Force Majeure

Explor42 facilitates race entries and travel-related services. The Company does not organize, manage, or control the sporting event itself.

The Company is not liable for delays, changes, or cancellations arising from circumstances beyond its control, including natural disasters, adverse weather, war, strikes, terrorism, political instability, government restrictions, pandemics, or epidemics.

If the event or Tour is cancelled, postponed, rescheduled, or materially altered by the Company’s partners or event organizers, the Company will make reasonable efforts to recover refundable amounts from suppliers. Recovery is not guaranteed.

Refunds are limited to the recoverable amounts received from suppliers, in accordance with their policies. Race registration fees and other non-recoverable costs remain non-refundable.

Any refund will follow the currency, exchange-rate, and non-refundable payment-gateway rules in Section 3. The Company is not responsible for indirect losses, including separately booked flights or visa expenses.

7. Travel Insurance

Comprehensive travel and medical insurance is mandatory.

The Participant must obtain insurance covering participation in the relevant sporting event, trip cancellation, medical expenses, personal liability, and emergency repatriation.

8. Participant Responsibilities and Conduct

The Participant must:

Provide complete and accurate personal, booking, and travel information.
Comply with event rules, airline requirements, local laws, and health and safety guidelines.
Treat fellow participants, event staff, Company representatives, and local communities respectfully.
Avoid disruptive or unlawful behaviour, harassment, and illegal substances.
Cooperate with Company representatives during emergencies where on-ground support is provided.

The Company may cancel a booking or remove a Participant from the group without refund if their conduct violates these terms, endangers others, or damages the Company’s reputation.

9. Third Party Services and Limitation of Liability

Accommodation, transport, event access, and other services may be provided by independent suppliers. Their terms and conditions apply to the relevant components of your booking.

To the maximum extent permitted by applicable law:

The Company is not responsible for a third party’s default, cancellation, or negligence.
The Company’s total liability for any claim shall not exceed the total booking amount paid by the Participant.
The Company is not responsible for indirect or consequential losses, including missed flights, medical emergencies, or personal injury.
The Company is not liable for visa rejections, delays, or refusal of event entry.

10. Complaints Governing Law and Jurisdiction

Complaints must be reported during the Tour or within seven days of Tour completion to hello@explor42.com. The parties will first attempt to resolve disputes amicably.

These Terms and Conditions are governed by the laws of the United Arab Emirates. Subject to any mandatory local consumer protection laws that apply, disputes fall within the jurisdiction of the competent courts of the United Arab Emirates.

11. Acceptance

By completing your booking and making payment, you confirm acceptance of these Event Experience Terms and Conditions and the Company’s general Terms and Conditions.
